1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and Xserve ("Company", "we", "us", or "our") concerning your access to and use of our mobile applications and services (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use our Services.

2. Eligibility

You must be at least 13 years old (or the age of consent in your jurisdiction) to use our Services. By using our Services, you represent and warrant that you meet this age requirement.

If you are using our Services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

3. User Accounts

3.1 Account Creation

Some of our Services may require you to create an account. When creating an account, you must:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account

3.2 Account Termination

You may delete your account at any time directly within the app. We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent, abusive, or illegal activity.

4. Acceptable Use

You agree not to use our Services to:

• Violate any applicable laws or regulations
• Infringe on the intellectual property rights of others
• Transmit harmful, threatening, abusive, or harassing content
• Distribute spam, malware, or viruses
• Attempt to gain unauthorized access to our Services or systems
• Interfere with or disrupt the integrity or performance of our Services
• Collect or harvest information about other users without consent
• Use automated systems (bots, scrapers) without our permission
• Impersonate any person or entity
• Engage in any activity that could harm minors

5. Intellectual Property Rights

5.1 Our Rights

All content, features, and functionality of our Services, including but not limited to text, graphics, logos, icons, images, audio, video, software, and design, are the exclusive property of Xserve or its licensors and are protected by copyright, trademark, and other intellectual property laws.

5.2 Your Rights

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use our Services for personal, non-commercial purposes.

5.3 User Content

You retain ownership of any content you create, upload, or share through our Services ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content solely for the purpose of providing and improving our Services.

6. Subscriptions and Payments

6.1 Subscription Terms

Some of our Services may be offered on a subscription basis. By purchasing a subscription, you agree to the following:

• Billing: Subscriptions are billed in advance on a recurring basis (monthly, yearly, etc.)
• Auto-Renewal: Subscriptions automatically renew at the end of each billing period unless cancelled
• Price Changes: We may change subscription prices with advance notice
• Cancellation: You may cancel your subscription at any time through your device's subscription settings

6.2 Free Trials

We may offer free trial periods for certain subscriptions. At the end of the trial period, you will be automatically charged unless you cancel before the trial ends.

6.3 Refunds

All payments are non-refundable except as required by law or as explicitly stated in the app. Refund requests should be made through the respective app store (Apple App Store, Google Play Store).

6.4 In-App Purchases

Some Services may offer in-app purchases. All purchases are processed through the respective app store and are subject to the app store's terms and conditions.

7. Third-Party Services and Links

Our Services may contain links to third-party websites or services that are not owned or controlled by Xserve. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party services. You acknowledge and agree that we shall not be liable for any damage or loss caused by your use of any third-party services.

8. Disclaimers and Limitations of Liability

8.1 Disclaimers

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Services will be uninterrupted, secure, or error-free
• The results obtained from using the Services will be accurate or reliable
• Any errors in the Services will be corrected

8.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, XSERVE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability to you for all claims arising from or related to the Services shall not exceed the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

9. Indemnification

You agree to indemnify, defend, and hold harmless Xserve, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

• Your access to or use of the Services
• Your violation of these Terms
• Your violation of any third-party rights
• Your User Content

10. Modifications to Services and Terms

10.1 Service Modifications

We reserve the right to modify, suspend, or discontinue any aspect of our Services at any time without notice or liability.

10.2 Terms Modifications

We may revise these Terms from time to time. The most current version will always be available in the app. If we make material changes, we will notify you through the app or by other means. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.

11. Governing Law and Dispute Resolution

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Sweden, without regard to its conflict of law provisions.

11.2 Dispute Resolution

Any disputes arising from or relating to these Terms or the Services shall be resolved through good-faith negotiations. If negotiations fail, disputes shall be resolved in the courts of Sweden.

12. Apple App Store Additional Terms

If you access our Services through the Apple App Store, the following additional terms apply:

• These Terms are between you and Xserve only, not with Apple
• Apple has no obligation to provide maintenance or support services
• Apple is not responsible for addressing any claims relating to the app or your use of it
• In the event of any third-party claim that the app infringes intellectual property rights, Xserve, not Apple, is responsible for the investigation and defense of such claim
• You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and have the right to enforce these Terms against you

13. Google Play Additional Terms

If you access our Services through Google Play, you agree to the Google Play Terms of Service available at https://play.google.com/about/play-terms/.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy and EULA, constitute the entire agreement between you and Xserve regarding the Services and supersede all prior agreements and understandings.

1. Godkännande av Villkor

Dessa Användarvillkor ("Villkor") utgör ett juridiskt bindande avtal mellan dig och Xserve ("Företaget", "vi", "oss" eller "vår") angående din åtkomst till och användning av våra mobilapplikationer och tjänster (kollektivt, "Tjänsterna").

Genom att komma åt eller använda våra Tjänster godkänner du att vara bunden av dessa Villkor. Om du inte godkänner dessa Villkor får du inte komma åt eller använda våra Tjänster.

2. Behörighet

Du måste vara minst 13 år gammal (eller samtyckesåldern i din jurisdiktion) för att använda våra Tjänster. Genom att använda våra Tjänster försäkrar och garanterar du att du uppfyller detta ålderskrav.

Om du använder våra Tjänster på uppdrag av en organisation, försäkrar du att du har behörighet att binda den organisationen till dessa Villkor.

3. Användarkonton

3.1 Kontoskapande

Vissa av våra Tjänster kan kräva att du skapar ett konto. När du skapar ett konto måste du:

• Tillhandahålla korrekt, aktuell och fullständig information
• Underhålla och omgående uppdatera din kontoinformation
• Upprätthålla säkerheten för dina kontouppgifter
• Acceptera ansvar för alla aktiviteter som sker under ditt konto

3.2 Kontoavslut

Du kan radera ditt konto när som helst direkt i appen. Vi förbehåller oss rätten att suspendera eller avsluta ditt konto om du bryter mot dessa Villkor eller engagerar dig i bedräglig, missbrukande eller olaglig aktivitet.

4. Acceptabel Användning

Du samtycker till att inte använda våra Tjänster för att:

• Bryta mot några tillämpliga lagar eller förordningar
• Kränka andras immateriella rättigheter
• Överföra skadligt, hotfullt, kränkande eller trakasserande innehåll
• Distribuera spam, skadlig programvara eller virus
• Försöka få obehörig åtkomst till våra Tjänster eller system
• Störa eller avbryta integriteten eller prestandan för våra Tjänster
• Samla in eller skörda information om andra användare utan samtycke
• Använda automatiserade system (bots, skrapor) utan vårt tillstånd
• Utge dig för att vara någon person eller enhet
• Engagera dig i någon aktivitet som kan skada minderåriga

5. Immateriella Rättigheter

5.1 Våra Rättigheter

Allt innehåll, funktioner och funktionalitet i våra Tjänster, inklusive men inte begränsat till text, grafik, logotyper, ikoner, bilder, ljud, video, programvara och design, är exklusiv egendom för Xserve eller dess licensgivare och skyddas av upphovsrätt, varumärke och andra immateriella rättigheter.

5.2 Dina Rättigheter

Med förbehåll för din efterlevnad av dessa Villkor ger vi dig en begränsad, icke-exklusiv, icke-överförbar, återkallelig licens att komma åt och använda våra Tjänster för personliga, icke-kommersiella ändamål.

5.3 Användarinnehåll

Du behåller ägandet av allt innehåll du skapar, laddar upp eller delar genom våra Tjänster ("Användarinnehåll"). Genom att skicka in Användarinnehåll ger du oss en global, icke-exklusiv, royaltyfri licens att använda, reproducera, modifiera och visa sådant innehåll enbart i syfte att tillhandahålla och förbättra våra Tjänster.

6. Prenumerationer och Betalningar

6.1 Prenumerationsvillkor

Vissa av våra Tjänster kan erbjudas på prenumerationsbasis. Genom att köpa en prenumeration godkänner du följande:

• Fakturering: Prenumerationer faktureras i förskott på återkommande basis (månatlig, årlig, etc.)
• Automatisk Förnyelse: Prenumerationer förnyas automatiskt i slutet av varje faktureringsperiod om de inte avbryts
• Prisändringar: Vi kan ändra prenumerationspriser med förhandsmeddelande
• Avbokning: Du kan avbryta din prenumeration när som helst genom din enhets prenumerationsinställningar

6.2 Gratis Provperioder

Vi kan erbjuda gratis provperioder för vissa prenumerationer. I slutet av provperioden kommer du automatiskt att debiteras om du inte avbryter före provperiodens slut.

6.3 Återbetalningar

Alla betalningar är icke-återbetalningsbara utom som krävs enligt lag eller som uttryckligen anges i appen. Återbetalningsförfrågningar bör göras genom respektive appbutik (Apple App Store, Google Play Store).

6.4 Köp i Appen

Vissa Tjänster kan erbjuda köp i appen. Alla köp behandlas genom respektive appbutik och är föremål för appbutikens villkor.

7. Tredjepartstjänster och Länkar

Våra Tjänster kan innehålla länkar till tredjepartswebbplatser eller tjänster som inte ägs eller kontrolleras av Xserve. Vi har ingen kontroll över och tar inget ansvar för innehållet, integritetspolicyer eller praxis för några tredjepartstjänster. Du erkänner och godkänner att vi inte ska vara ansvariga för någon skada eller förlust orsakad av din användning av några tredjepartstjänster.

8. Ansvarsfriskrivningar och Begränsningar av Ansvar

8.1 Ansvarsfriskrivningar

VÅRA TJÄNSTER TILLHANDAHÅLLS "I BEFINTLIGT SKICK" OCH "SOM TILLGÄNGLIGA" UTAN GARANTIER AV NÅGOT SLAG, VARE SIG UTTRYCKLIGA ELLER UNDERFÖRSTÅDDA, INKLUSIVE MEN INTE BEGRÄNSAT TILL UNDERFÖRSTÅDDA GARANTIER FÖR SÄLJBARHET, LÄMPLIGHET FÖR ETT VISST ÄNDAMÅL OCH ICKE-INTRÅNG.

Vi garanterar inte att:

• Tjänsterna kommer att vara oavbrutna, säkra eller felfria
• Resultaten som erhålls från användning av Tjänsterna kommer att vara korrekta eller tillförlitliga
• Eventuella fel i Tjänsterna kommer att korrigeras

8.2 Ansvarsbegränsning

I DEN UTSTRÄCKNING SOM TILLÅTS ENLIGT LAG SKA XSERVE INTE VARA ANSVARIG FÖR NÅGRA INDIREKTA, TILLFÄLLIGA, SPECIELLA, FÖLJDSKADOR ELLER STRAFFSKADOR, ELLER NÅGON FÖRLUST AV VINSTER ELLER INTÄKTER, OAVSETT OM DE UPPKOMMIT DIREKT ELLER INDIREKT, ELLER NÅGON FÖRLUST AV DATA, ANVÄNDNING, GOODWILL ELLER ANDRA IMMATERIELLA FÖRLUSTER.

Vårt totala ansvar gentemot dig för alla anspråk som uppstår från eller relaterar till Tjänsterna ska inte överstiga det belopp du betalat oss under de 12 månaderna som föregår anspråket, eller 1000 SEK, beroende på vilket som är högst.

9. Skadestånd

Du samtycker till att gottgöra, försvara och hålla Xserve, dess tjänstemän, direktörer, anställda och ombud skadeslösa från och mot alla anspråk, skulder, skador, förluster och utgifter, inklusive rimliga advokatarvoden, som uppstår från eller på något sätt är kopplade till:

• Din åtkomst till eller användning av Tjänsterna
• Din överträdelse av dessa Villkor
• Din överträdelse av tredje parts rättigheter
• Ditt Användarinnehåll

10. Ändringar av Tjänster och Villkor

10.1 Tjänständringar

Vi förbehåller oss rätten att ändra, suspendera eller avbryta någon aspekt av våra Tjänster när som helst utan föregående meddelande eller ansvar.

10.2 Villkorsändringar

Vi kan revidera dessa Villkor från tid till annan. Den mest aktuella versionen kommer alltid att vara tillgänglig i appen. Om vi gör väsentliga ändringar kommer vi att meddela dig genom appen eller på annat sätt. Din fortsatta användning av Tjänsterna efter sådana ändringar utgör ditt godkännande av de nya Villkoren.

11. Tillämplig Lag och Tvistlösning

11.1 Tillämplig Lag

Dessa Villkor ska styras av och tolkas i enlighet med svensk lag, utan hänsyn till dess lagvalsprinciper.

11.2 Tvistlösning

Alla tvister som uppstår från eller relaterar till dessa Villkor eller Tjänsterna ska lösas genom förhandlingar i god tro. Om förhandlingarna misslyckas ska tvister lösas i svenska domstolar.

12. Apple App Store Ytterligare Villkor

Om du kommer åt våra Tjänster genom Apple App Store gäller följande ytterligare villkor:

• Dessa Villkor är mellan dig och Xserve endast, inte med Apple
• Apple har ingen skyldighet att tillhandahålla underhålls- eller supporttjänster
• Apple är inte ansvarig för att hantera några anspråk som rör appen eller din användning av den
• I händelse av att en tredje part gör anspråk på att appen kränker immateriella rättigheter, är Xserve, inte Apple, ansvarig för utredningen och försvaret av sådant anspråk
• Du försäkrar att du inte befinner dig i ett land som är föremål för ett embargo från USA:s regering eller utsett som ett "terroristiskt stödjande" land
• Apple och Apples dotterbolag är tredje parts förmånstagare av dessa Villkor och har rätt att genomdriva dessa Villkor mot dig

13. Google Play Ytterligare Villkor

Om du kommer åt våra Tjänster genom Google Play godkänner du Google Play-användarvillkoren som finns på https://play.google.com/about/play-terms/.

14. Delbarhet

Om någon bestämmelse i dessa Villkor befinns vara icke verkställbar eller ogiltig, ska den bestämmelsen begränsas eller elimineras i minsta nödvändiga utsträckning, och de återstående bestämmelserna ska förbli i full kraft och verkan.

15. Hela Avtalet

Dessa Villkor, tillsammans med vår Integritetspolicy och EULA, utgör hela avtalet mellan dig och Xserve angående Tjänsterna och ersätter alla tidigare avtal och förståelser.
